This area of the law is constantly evolving and it seems no matter whether a client is a Landlord or a Tenant, each feels that the Courts favor the other. The primary source of disputes we have seen involve defining the terms of the Lease and how it applies to each party, both during the term of the lease and also after the end of the term.. The various states have very specific laws about this special relationship between parties who each hold some measure of ownership interest in the same parcel of real estate. Your lease should be 'plain language' and easy to understand. Before entering into a lease, you should have any terms which you don't understand fully explained to you by your attorney. If a problem arises, during the term of your lease or after the expiration of the term, either as Landlord or as Tenant, you should avoid 'self-help' measures and immediately consult your attorney. Attempting to resolve a problem without legal counsel could lead to diminishing or even extinguishing rights you have. |
