In New Jersey, the Municipal Court system is set up to handle complaints or disputes which arise under the Traffic Code and certain non-indictable activities under the Criminal Code. Also heard in Municipal Courts are complaints arising under the local codes of the municipality. The Municipal Courts do not award monetary damages although they have the authority to order restitution. Driving under the influence, driving while privileges have been revoked and driving an unregistered or uninsured motor vehicle are very common charges heard in these Courts. Some of these offenses have consequences of magnitude including substantial fines, loss of driving privileges for extended periods of time and possibly even jail time for repeat offenders. I highly recommend that persons charged with these offenses at least consult an attorney well before the scheduled Court Date. Your attorney will need time to enter his or her appearance with the Court and to receive discovery from the State. Waiting until the last minute to retain an attorney will more than likely mean you will have to make at least two appearances in Court. Other matters frequently heard in Municipal Courts are disputes between neighbors, complaints related to unlicensed dogs and disturbing the peace offenses. You may or may not need an attorney for these minor matters, but if in doubt, you should at least consult with an attorney to be sure. Again, allow enough time for your attorney to do a good job for you. |
