Post-Nuptial Matters

For those persons seeking to leave a marriage, the needs could be even greater to ensure a fair distribution of assets accumulated during the time of the relationship.  Some states take a 'community property' approach while others, including New Jersey, take an 'equitable distribution' approach.  In New Jersey this simply means that the Courts are seeking to ensure that marital assets are distributed equitably, or 'fairly.'

It is often efficient and easier for the partners to work out the details of distributing property before heading into the Court House. By creating a mutually agreeable Property Settlement Agreement with the help of each party's attorney, much time and many potential problems can be resolved including decisions such as:

  • support from one spouse to the other
  • support of children
  • visitation issues concerning children
  • the splitting of assets appropriately.

Waiting until you are on the Court House steps to think about these issues is sure to leave both parties very unhappy in the end.
